Terms of use

The rules for using this website: what it offers, what is ours, what you may do and how to reach us.

Summary

  • The website is free, needs no registration and presents the studio and its games.
  • Information about the games describes projects in development and may change; nothing here is an offer, a pre-order or a promise of release.
  • The website’s texts, images, design and code are ours, and the names Fersan Interactive, Rivalstride and Crane Crazy identify the studio and its games. You may view, share links and quote excerpts with credit; other uses need permission.
  • We do not accept unsolicited game ideas.
  • These terms follow Brazilian law, without removing your rights as a consumer.

Who we are

This website, fersaninteractive.com, belongs to FERSAN INTERACTIVE LTDA, CNPJ (Brazilian company registration) 66.561.110/0001-30, registered at Rua M.M.D.C., 80, Sala 1210 A2, Butantã, São Paulo/SP, CEP 05510-021, Brazil (“Fersan Interactive”, “we”). Contact: contact@fersaninteractive.com.

What these terms cover

These terms apply to the use of the website fersaninteractive.com, in English and in Portuguese.

The studio’s games, their demos, tests, stores and communities will have their own terms, such as licence agreements and each platform’s rules, published when they exist. These terms do not replace them.

How personal data is handled is described in the privacy policy, a separate document that does not depend on acceptance.

Using the website

The website is free and can be used without registration. By using it, you agree to do so in line with these terms and the law. If you do not agree, do not use the website.

You must have the capacity to take on the obligations in these terms or use the website under the supervision of a parent or guardian.

Information about the games

Rivalstride and Crane Crazy are in development. The names, descriptions, images, features, platforms and dates shown on the website reflect the current state of each project and may change or be dropped before release.

The website’s content is informative. It is not an offer, pre-order, reservation or promise of release on any date or platform. When a game is on sale, the terms of the store that sells it will apply.

Intellectual property

The website and its content, including texts, images, design, layout, code and the selection and arrangement of this material, belong to Fersan Interactive or are used with permission, and are protected by copyright law (Brazilian Law 9,610/1998) and by the specific software legislation.

The names Fersan Interactive, Rivalstride and Crane Crazy, as well as logos and other distinctive signs, identify the studio and its games. Using the website gives you no licence to them beyond what these terms allow.

Some parts of the website use third-party material under its own licence. The Archivo and IBM Plex Mono typefaces are distributed under the SIL Open Font License 1.1, published on the website at /fonts/Archivo-OFL.txt and /fonts/IBMPlexMono-OFL.txt; “Plex” is a reserved name of IBM.

What you may do

  • View the website and print or save pages for personal use.
  • Share links to any page.
  • Quote short excerpts for news, reviews, study or commentary, crediting Fersan Interactive as the source, within the limits of the law (Brazilian Law 9,610/1998, art. 46).

What is not allowed

  • Copying, reproducing, distributing, modifying or commercially using the website’s content beyond what these terms, the law (such as the limitations in art. 46 of Law 9,610/1998) or the third-party licences listed above allow, without written permission.
  • Using the names, logos or images of the studio and its games in a way that suggests a partnership, sponsorship or endorsement that does not exist, or that misleads the public.
  • Displaying the website inside another website (framing) or presenting it as someone else’s.
  • Collecting the content automatically and in bulk, including for text and data mining or to train artificial intelligence models, without written permission. Indexing by search engines that respect the /robots.txt file is allowed. This is an express reservation of rights, including for the purposes of Article 4(3) of Directive (EU) 2019/790.
  • Overloading the website, interfering with how it works, trying to reach non-public areas or systems or getting around security measures.
  • Using the contact channels for spam, harassment, unlawful content or to impersonate someone else.

Press and fan content

The press page offers the press kit and the brand guidelines, with the conditions for using them shown next to the files: to refer to the studio and its games in news, reviews, articles, videos, streams and events, as supplied, without suggesting partnership, sponsorship or endorsement. When we publish rules for fan-made content, they will come with their own terms of use. For any other use of images or materials from the website, write to press@fersaninteractive.com.

Messages and unsolicited ideas

Messages sent to our email addresses are handled under the privacy policy. Do not send confidential information: a message does not by itself create a duty of confidentiality over its business or creative content, or a contractual relationship. This does not change how your personal data is protected, as described in the privacy policy.

We do not accept ideas, stories, characters, mechanics or other creative material for games that we have not asked for. If you send something like that, we take on no obligation to review, keep confidential, use or pay for it. The studio may be developing, or may come to develop, similar ideas independently. A reply from us does not mean we accept or are interested in a proposal.

Reporting vulnerabilities

If you find a security vulnerability on the website, write to security@fersaninteractive.com with a description and the steps to reproduce it. The /.well-known/security.txt file gives the same contact.

The website is static and hosted by Google (Firebase Hosting); we cannot authorise testing of Google’s or other providers’ infrastructure, and issues in it should be reported to them directly.

We ask you to act in good faith: do only what is needed to demonstrate the issue; do not access, change or delete other people’s data; do not disrupt the website; do not use high-volume automated scanning, social engineering, denial-of-service attacks or physical tests; and give us a reasonable time to fix the problem before disclosing it. We will confirm receipt and keep you informed about the fix. We do not offer financial rewards for reports.

The website may link to stores, platforms, social networks and other websites. We do not control them, and a link does not mean we endorse their content. When you follow it, you use that service under its own terms and privacy policy.

Notices about content

The website does not publish user content, advertising or boosted content. If you believe any of its content is criminal or unlawful, or infringes a right of yours, such as copyright, write to contact@fersaninteractive.com identifying yourself, pointing to the page and the content and explaining why. We will confirm receipt, review the notice and reply with our decision, the reasons for it and how to ask us to reconsider.

Availability and changes to the website

We may change, update, suspend or close the website or any part of it at any time, for example for maintenance, fixes or changes to the projects. We do our best to keep it running without interruption but cannot guarantee continuous availability.

Liability

We work to keep the website’s information correct and up to date, but it may contain errors or become outdated, and we will correct it when we find out. We are liable for damage we cause, as provided by law.

To the extent the law allows, we are not liable for damage resulting from:

  • use of the website in breach of these terms or the law;
  • the content, products or practices of third-party websites;
  • failures of your connection or equipment, or of third-party services we have not engaged;
  • decisions based solely on information about games in development.

Nothing in these terms removes rights that the law guarantees and that cannot be waived, including those under Brazil’s Consumer Protection Code, or liability for wilful misconduct or gross negligence.

Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district (comarca) of São Paulo, State of São Paulo, are chosen. If you are a consumer, you may bring a claim in the courts of your domicile, and any claim of ours against you will be brought there (Brazilian Consumer Protection Code, art. 101, I).

If you wish, write first to contact@fersaninteractive.com; this is not a condition for going to court or to consumer protection bodies.

General provisions

If any clause of these terms is held invalid, the others remain in effect (Brazilian Civil Code, art. 184). Not enforcing a rule does not mean waiving it.

Changes to these terms

Each version of these terms has a number and the date it takes effect, shown at the top of the page. When we change the terms, we will publish the new version here, with the next number and a summary of what changed at the top of the page; it applies from its effective date and does not reach earlier events. Because the website has no registration, we cannot notify you individually: each new version is published on this page before it takes effect. The history at the end of the page lists every version and the period each one was in force, and earlier versions remain available to read, unchanged.

Language and contact

These terms exist in Portuguese and English, with the same content. If they differ, the Portuguese version prevails, without prejudice to the interpretation most favourable to the consumer (Brazilian Consumer Protection Code, art. 47).

Questions about these terms: contact@fersaninteractive.com or FERSAN INTERACTIVE LTDA, Rua M.M.D.C., 80, Sala 1210 A2, Butantã, São Paulo/SP, CEP 05510-021, Brazil.
